The Criminal Division of the Clerk of Courts Office is responsible for managing and retaining records of all felony cases in Cuyahoga County. 

The Criminal Division of Common Pleas processes all felony cases bound over to the grand jury and all grand jury indictments. It also prepares for, schedules and oversees Common Pleas arraignments; and dockets and files all motions, entries, warrants, and summons relating to criminal cases. This division creates and processes all warrants and issues subpoenas for criminal cases.

The Criminal Division accepts all filings pertaining to felony cases. 

Also filed are cases on defendants arrested on out of county warrants, extraditions from other states, and expungements.

Upon application by the defendant or attorney and an order by the Court, criminal cases can be expunged. The fee is $50.00 for convictions. There is no fee if the case was dismissed or there was a finding of not guilty.

Criminal cases come to the Clerk’s Office in the following manner:

Bindovers from Juvenile Court - These are cases where juveniles are being tried as adults.  No hearing is scheduled until there is a Grand Jury indictment.

Bindovers from Municipal Court - Persons arrested are arraigned in Municipal Court.  If the charge is a felony and the attorney waives the preliminary hearing, the case is bound over to the Common Pleas Court.  The bond set in Municipal Court will follow the case to Common Pleas.  If the charge is a felony and the preliminary hearing is not waived, the case is dismissed for a direct indictment.   Hearings are not scheduled on either type of case until the case is presented to Grand Jury and an indictment is returned.

Direct Indictment - Cases dismissed in Municipal Court for directs or cases presented directly to the Grand Jury as a result of an investigation.  There is no bond on these cases until the arraignment or until an attorney requests a bond hearing.

Bonds on felony cases are posted with the Criminal Division. The types of bonds, as set by the court, include:

Personal - signature bond
Cash - full amount of bond in cash
Property
- by approval of Court and if property qualifies

Surety
- must go through Bail Bonding Company
Cash Deposit
- 10% of amount  of bond 

Bonds must be posted by 4:20 PM on weekday evenings, and by 12:30 PM on Saturdays.

All information about felony cases is open to the public except information concerning Grand Jury, and cases that have been expunged. A research area, with computer terminals and printers is available. Copies can be obtained for a fee.
